Oakland Tactical v. Howell Township (6th Circ. 2022) is the latest case to be GVRed (grant writ of certiorari, vacate, and remand). The district court has to rehear the case with the two-step intermediate scrutiny test. I am hard pressed to see how they will lose.
This could be HUGE. If the circuit says that they can't regulate a rifle range any differently than they would have at the time of the founding, then that could squash a whole bunch of anti-gun range regulations.
ReplyDeleteI suspect that any founding era shooting range rules would be limited to "don't put bullet holes in people or houses, don't be a jerk and shoot at 2AM."
