I have heard even some Trump supporters ask, "Why did Pence not do what Trump asked him to do in the dispute over the electors?" American Mind explains what was requested and why Pence did not do it. Not as a slight to Trump as some of the news media implied but because the law is than clear about what Pence's role could be:
In his letter of the morning of January 6, Vice President Mike Pence asserted that “[s]ome believe that as Vice President, [he] should be able to accept or reject votes unilaterally.” He repeated the claim later in the letter: “vesting the vice president with unilateral authority to decide presidential election contests would be entirely antithetical to [the] design” of separation of powers and checks and balances given to us by our founders. And then a third time, he wrote: “I do not believe that the Founders of our country intended to invest the vice president with unilateral authority to decide which electoral votes should be counted during the Joint Session of Congress.” And a fourth: “It is my considered judgment that my oath to support and defend the Constitution constrains me from claiming unilateral authority to determine which electoral votes should be counted and which should not.” ...
A good number of legal scholars agree that [the Electoral Count Act of 1887] Section 15’s provision of tie-breaking weight to the “executive” (as opposed to the legislatively-sanctioned slate) is a violation of Article II’s assignment to the Legislature of the power to choose the manner for choosing electors. But legal scholars, as well as historical political figures, have also contended that that Congress’s claim of authority to make that determination at all is itself a usurpation of power that the 12th Amendment assigns solely and exclusively to “the president of the Senate.”
Yeah and I have a bridge in Brooklyn that you'd be interested in.
ReplyDeleteThe Constitution explicitly places the selection of electors in the hands of the state legislatures, not the democrat party cheat machine, or the RINO governors they control. Seven state legislators sent electors to DC to contest the blatantly fraudulent results signed off on by their RINO governors. Pence sided with the election thieves, completely. He isn't any kind of patriot, he's a straight fucking Judas Quisling, who personally signed off on the fascist takeover of America.
ReplyDeleteAnd he's a fool if he thinks Patriots are going to forget his role in the Fall of the Republic.
