Promoting racial equity in the criminal legal system by eliminating drive-by shooting as a basis for elevating murder in the first degree to aggravated murder in the first degree.
It is not white neighborhoods that are at high risk of drive-by shootings. It is not white mothers putting their kids to bed in tubs to provide protection from stray bullets.
It's probably not a bad idea.
ReplyDeleteI'd bet that aggravated murder in the first degree carries a penalty of life without parole or the death penalty (either or), and that by leaving it at simple murder one you stand a better chance of getting a conviction.
