This Should Seem a Clear-Cut Decision, But I Am Sure Progressives Will Be Calling This a Rape Promoting Decision in 3...2...1

9/29/25 Volokh Conspiracy cites a recent decision that:

In October 2020, University of Maryland student Jane Roe … alleged that John Doe …, the plaintiff here, and another student had sexually assaulted her in separate incidents on the same morning. Following an investigation, the University concluded that Doe was not responsible for any wrongdoing. Nevertheless, Roe and others embarked on a months-long public campaign to brand Doe a rapist and to exclude him from campus activities. Doe now asserts that the University's failure to address this hostile, sex-based campaign violated Title IX….

[T]he persistent pattern of publicly identifying [Doe] as Roe's "rapist" which led to his removal from Club Lacrosse, constitutes harassment directed at his sex. "Sexual harassment" includes "sex-specific language that is aimed to humiliate, ridicule, or intimidate." Plainly, a reasonable juror could conclude that persistent public pronouncements that Doe is a "rapist," a "sexual predator" and "dangerous to girls on campus," is language aimed at his sex and his sexual conduct.

This will doubtless be a surprise to feminists but falsely accusing someone of being a rapist is a serious attack.

1. There are very serious Christian college men who would find this offensive because it accuses them of not remaining clean of improper premarital sexual behavior.

2.  Even those not so constrained would regard this as an accusation that they lack adequate salesmanship/begging skills.

I have posted in the past about false rape accusations destroying the career possibilities of young men, usually black young men, who seem to lack sufficient points in the current hierarchy of victimhood.  

If the university had no basis for holding an opinion about whether the accusation had merit, this would be a simple question of slander by other students.  But the University had investigated and found the accusation meritless.  Its failure (does the University have preferred pronouns?) to deal with what it knew to be false accusations seems to be part of the continuing war on men.  This doubtless plays a role in the increasingly absurd sex imbalance on college campuses.

Believe Every Woman

A University of Minnesota Law School professor, Francesco Parisi, has won a nearly $1.2 million defamation case against a woman who had falsely accused him of rape.

In his blistering ruling on Tuesday, Hennepin County Judge Daniel Moreno wrote that Parisi’s former lover, Morgan Wright, had pursued an “untruthful narrative crusade,” and her “accusations were false, and made with malice.”

Kavanaugh Not the Only Victim

3/13/20 DailyWire:
Two years ago, a woman named Halina Kuta told Las Vegas police that casino mogul Steve Wynn raped her in the early 1970s and that she was the real mother of Wynn’s daughter, whom she claimed to have birthed in a gas station restroom.
Despite the implausibility of Kuta’s allegations – she also claimed to have been a model for Pablo Picasso’s painting “Le Reve,” which was painted more than 10 years before Kuta was born – the media ran with the allegations against Wynn because of the #MeToo movement’s hysteria over powerful men getting accused of sexual misconduct. Wynn sued Kuta for defamation and has now won.
This week, however, The Associated Press reported that Clark County District Court Judge Ronald Israel awarded Wynn the $1 in damages that Wynn sought from Kuta, ruling that the woman did, in fact, defame the former casino mogul, who resigned in February 2018 as chairman and chief executive of Wynn Resorts.
“I find that Mr. Wynn’s testimony is credible and Ms. Kuta’s testimony lacks veracity in numerous areas,” Israel ruled, adding that Kuta “knowingly made a false report” to the Las Vegas police.
“This was intentional,” Israel added, “although this story seems to be totally fanciful.”
I hope Wynn gets his job back.

But the same standard of proof applies as it does for any other crime.  5/19/19 The Smoking Gun reports on a case where the victim later admitted that she made it up, but not before someone was killed in self-defense, after she claimed someone banging on her door sounded like her (non-existent) rapist.

Wow! Selfies Have Value Other Than Expressing Narcissism

11/13/18 WWL channel 4:
Why had police come to his work and arrested him? Why was he being accused of these horrible crimes? Who was accusing him?
She said he broke into her home in Temple.
She said he sliced an "X" into her chest with a box cutter.
She said it happened on Sept. 20, 2017 around 7:20 p.m....
On the night of the alleged attack, he was with his mother, Erin, at a Northwest Austin hotel about 65 miles from the accuser's home.
"I'm thinking, 'this is awesome. By the grace of God, she said it happened on the day when I can say totally, 100 percent, where he was at," Erin Precopia said.
There were sworn affidavits from several people who were with him that evening.
There were pictures to prove it, and they were posted on Facebook.
Timestamped. Geo-located.
An alibi.
"Most of the time, we deal with gray matters," attorney Rick Flores said. "It's not normally black or white. But this is one of those cases where I could definitely prove he did not commit this offense."
Charges were dropped; the accuser has not been identified because she has not been charged with a crime.  Why not?  Rape was not claimed, but  Believe All Women.

11/14/18 Daily Wire reports on a Tampa cop fired after a woman he pulled over claimed a sexual assault:
The woman, according to Escobar, York’s attorney, refused a full medical exam and would not give blood and urine samples. She insisted, oddly, that they focus on her underwear and a tampon she was using at the time of the alleged incident. The tampon was never found.
A DNA swab of her underwear, taken from the front material, found York’s DNA. Normally this would be the nail in the coffin for someone accused — and at first it looked that way for York. But his attorneys argued that the DNA — known as touch DNA — could have gotten on her underwear some other way. You see, touch DNA refers to the skin cells one leaves on an object after they have touched it. York’s attorneys argued the woman rubbed her driver’s license (which York had touched during the traffic stop) on her underwear to transfer the DNA.
Her story to investigating officers kept changing.  Worse:
One of the detectives assigned to the case never interviewed the officers who first spoke to York’s accuser at the hospital. This detective didn’t even read their reports until her deposition with Escobar, the attorney said. This detective also refused to record the accuser’s interviews because, she said, she might change her story later and this would not allow her to do so. [emphasis added]
You can see why the DA dropped the charges, and how innocent people get tried for, and convicted of rape.  If the accuser's story changes, that might create doubt as to the truthfulness of the accusation.  Not recording an interview to allow her to change her story is clearly bad police work. 

And that touch DNA evidence has all sorts of opportunity's for misuse.  We found Mr. A's DNA on the murder weapon.  Perhaps he touched it in a gun store a day or two before Mr. B came in to buy it.  Admittedly, gun stores usually wipe down the gun (at least to get the drool marks off), but touch DNA seems a pretty questionable form of evidence.

Oh and Tampa PD won't rehire this guy.  I am guessing the SJWs now run that department.

Believe All Women!

11/2/18 WBKO:
Carlotta Lynn Merchant reported on Oct. 18 that someone wearing a ski mask and clear gloves forced entry into her home on N. 6th Street and sexually assaulted her.
On Oct. 23 police say Merchant called the detective assigned to the case and confessed to staging the crime scene and making up the sexual assault so she could get sympathy from an estranged boyfriend.

Not with this many false rape accusations.  10/23/18 Seattle Times about rape accusations against Bellevue police chief and two of his detectives:
His accuser, a 44-year-old Issaquah woman, came forward in early August with claims Mylett had raped her two years earlier during an encounter at his Bothell home arranged through an adult sex website. The allegations emerged as the King County Sheriff’s Office separately investigated the woman’s claims against two other Bellevue police officers that initially led to domestic-violence assault and witness-tampering charges against one of them....
Bothell investigators found Mylett’s accuser had gone so far as to create phony, backdated email exchanges that contained the address of a Bothell rental home where Mylett temporarily lived. But lease records and other evidence proved Mylett had moved out of that house prior to when the woman claimed the assault occurred, and DNA tests ruled Mylett out as a possible match to genetic evidence gathered from clothing the woman turned over as part of the case.
Rape claims should always be taken seriously, but false rape accusations are hardly rare, and due process and burden of proof need to be taken seriously--and not just Supreme Court nominees.

There Should Not Be This New Label

But believe all rape accusations has become the new slogan of the left, so a new label: false rape accusations.  These are cases not where the prosecution failed to prove its case, but where prosecutors dropped charges when evidence demonstrated that the victim made it up. 10/1/18 Las Vegas Review-Journal:
Prosecutors dropped charges Monday against four California dentists, including three brothers, who defense attorneys said were falsely accused of raping a woman at a Las Vegas Strip hotel.

“After review of the facts of the case, it was clear that the allegations were completely fabricated,” lawyers for the men wrote in a prepared statement before a court appearance. “The evidence confirmed the men’s innocence, and the state has cleared them of all charges.”
