"Struck" is a pretty strong word, considering that he was filmed walking around and talking with other ICE agents for well over a half hour, with no sign of injury and that he was taken later to the emergency room and released without treatment.
At best he was brushed aside.
If I hit you with a car, there will be no question as to whether you have been "struck".
Bruises can take a while to leave visible signs. Even if he was not seriously injured, striking him was certainly creating risk of injury. He might have slapped the hood, roughly equivalent being close enough to a bullet to hear it whiz past. Criminal intent is there.

ReplyDeleteOddly enough, he was videoed for about 15 minutes after the incident, where he showed no sign of injury in his walking or other actions.
