Why Many Arms Laws Challenges Do Us No Good

"BOISE, Idaho — What was a routine traffic stop for Boise police officers early Friday morning became a bomb situation when a suspected homemade pipe bomb was found after arresting two people during a traffic stop.

"The Boise Police Department said officers pulled over a vehicle at 12:45 a.m. at the intersection of South Broadway Avenue and West Linden Street, and the driver was arrested on driving under the influence charges. The passenger was arrested on an outstanding warrant."

A couple of outstanding citizens, what?  I doubt any public defender is going to make a Second Amendment challenge on this even though there is a plausible historical argument that this a protected "arm."  Such a challenge is going to get little sympathy,  especially with this fact pattern.  While an insurrectionary model argument could be plausible made, I rather doubt he was transporting it for that purpose.  The self-defense theory for a pipe bomb is also hard.
