This is a way forward from what is certainly the grossest vote fraud in American history. U.S. Constitution Art II, Sec. 1, directs that: "Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector." In the absence of a clearly honest vote for President, a majority of the legislature enjoys the unqualified authority to selects its state's electors. This section does not obligate the legislature to follow any statutory provisions already in place. This might seem politically risky, but I assume that any Republicans in either body of legislature represent districts where nearly every registered Republican and more than a few registered Democrats voted for Trump. The Electoral College's indirect system for election was an expression of concern by the Framers of an unqualified person of charm obtaining the presidency by winning the popular vote. Even more so does it make sense as a firewall between blatant voter fraud and the Presidency.

ReplyDeleteConsider, however if SCOTUS issues an order to do exactly that. The election is going there, as was always ordained and whatever they decide (or refuse to decide) is going to enrage half the country. The facts on the ground in those states (plus Wisconsin) make it essentially impossible for the Supreme Court to determine who actually won. Lots of evidence was destroyed and I don't think lawyers are capable of figuring out the statistical and IT evidence even if it were preserved. So the Supreme Court says "we can't figure it out, use your best judgment, as the Constitution provides". This displaces anger from the Court to the legislatures, something the Chief Squish would probably be in favor of. All the disputed states except NV have Republican legislatures which would indicate Trump wins. However, there is nothing to prevent the legislatures from splitting their EVs and PA actually did this in 1800. Couple of ways to do this. They all become ME and NE and do it by congressional district with 2EVs going to the overall winner. Or they could just do a proportional split based on the reported vote. Or something else. Different states could do it different ways. I haven't tried to count EVs since there are just too many variables. Whoever went last could even jigger the vote to make it 269-269 thus tossing it into the House and displacing blame yet again.
Downside is that this virtually ensures a collision between a leftist mob and a Trump Train in one or more state capitals.
