A Question For My Readers
Why is burning thec American flag or making porn that appears to involve children protected as free speech because it is expressive conduct, but refusing to make a same-sex wedding cake is not?
Why is burning the American flag or making porn that appears to involve children protected as free speech because it is expressive conduct, but refusing to make a same-sex wedding cake is not?
All are both protected conduct, if the key word is appears. If it does actually involve children, it should be criminal and should be very serious criminal conduct. I'm fine with exploiting children for sexual purposes being a capital crime.
Because burning a flag is public commentary, a political statement, and thus easy to deem "protected".
But quietly and privately refusing to compromise your personal principles ... whatever they are ... is tantamount to refusing to seat black people at the counter of your cafe in Selma, Alabama, and as such is denying civil rights to people you've never met.
You have no reason to deny service to 'that individual', and so you must be racist/sexist/homophobic/whatever the daily hate defines as 'unacceptable'.
It's a confusing old world these days, and nobody knows the rules yet.
One thing is sure: whatever you do, it's going to be wrong, and hateful, and punishable by a day in the stocks.
It's because businessmen have no rights that a good progressive is bound to respect. Try to make a business out of flag-burning or porn, and the bureaucrats will crack down on that, too. (See "Operation Choke Point" for example.)
